Former Army Commander Sarath Fonseka and captain Senaka Haripriya de Silva who worked as his secretary, pleaded not guilty to all the charges levelled against them including illegally harbouring ten soldiers.
This was when the case against the former Army Commander and his Secretary was taken up before Colombo High Court judge, Sunil Rajapakse Tuesday.
Fonseka and de Silva have been charged with turning ten soldiers against the state and making them disloyal towards their superiors.
Brigadier Ashoka Weerasinghe gave evidence during Tuesday’s court proceedings.
He said that the soldiers who were with Fonseka as his body guards when he was the Chief of Defence of Staff, were not relieved of duty.
Thereby on the night of the 5th of November 2009, a group of soldiers headed by a lieutenant Colonel, were deployed to Sarath Fonseka’s residence.
Brigadier Ashoka Weerasinghe said that the group had informed him on this instance that Fonseka had threatened them.
Brigadier Weerasinghe added that subsequently, steps were taken to recall the team.
He noted that the following morning, 26 vehicles and 6 soldiers who were with Fonseka were returned.
Brigadier Weerasinghe noted however that 12 soldiers did not return and steps were thus taken to treat them as deserters.
The case will be taken up again on the 15th of this month.
